Development Criteria and Guidelines:
- All submitted applications must, at a minimum, be compatible with either Apple iOS or Google Android operating systems. You are welcome to submit apps compatible with any additional operating systems and platforms, including web-based apps, and entries submitted that are compatible with multiple platforms may or may not have an advantage in the contest. Please note, that there will be only one winner selected amongst all entries, regardless of platform;
- Participants shall have access to, and the right to use, the following material ("Authorized Materials") solely in connection with the Submission and for no other purpose. Click here for instructions.
- We encourage you to include additional functionality and mash up your app with location-based services and components, augmented reality, streaming of real-time video and data, sharing and messaging functionality, and other added functionality and tools;
- Applications featuring nudity, profanity, unlicensed content or, otherwise inappropriate or illegal content will not be accepted under any circumstances (if you wonder if it crosses the line, it probably does);
- Submission must be in the English language;
- An entry may be re-submitted for corrective reasons, so long as it meets all rules herein and is submitted by the same Entrant before the Closing Date;
- Each Submission must be suitable for display and publication on national television; it must not contain defamatory statements (including but not limited to words or symbols that are widely considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation or socioeconomic group), it must not include threats to any person, place, business, group or world peace, it must not invade privacy or other rights of any person, firm or entity, and it must not in any other way violate applicable laws and regulations or network standards;
- Submissions must not contain material which is (or promoting activities which are) sexually explicit, obscene, pornographic, violent, self-mutilating (e.g., relating to murder, the sales of weapons, cruelty, abuse, etc.), discriminatory (based on race, sex, religion, natural origin, physical disability, sexual orientation or age), illegal (e.g. underage drinking, substance abuse, computer hacking, etc.), offensive, threatening, profane, or harassing;
- Submissions must not have been previously submitted to another Contest, broadcast on a competing media network or submitted to any entertainment entity that would conflict with this Contest, as determined in the Sponsor's sole discretion;
- Other than the Authorized Material, Submissions must not include 3rd party trademarks, logos, insignia, location signage, photographs, artwork, or sculptures; or include 3rd parties, including but not limited to minors, celebrities and friends who have not expressly authorized entrants to display their image, likeness or voice in any submitted video or otherwise use such image, likeness or voice in accordance with these Contest Rules;
- Any music featured in a Submission must be originally written, performed and produced by Entrant only and must be available to publicize and broadcast on a license-free, no compensation basis; and
- Submissions that do not comply with these Official Rules or that otherwise contain prohibited, or inappropriate content as determined by the Sponsor, in its sole discretion, will be disqualified and will not be considered for a prize. Sponsor makes the final determination as to which Submissions are eligible to take part in this Contest and be considered for a prize.
Eligible Participants
The Contest is open to:
- Any professional or amateur developer legally residing in the United States, who are 18 years of age or older (and not a minor in his/her state of residence) ("Entrant").
- The following individuals are not eligible employees, contractors, directors and officers of Sponsor, FOX, Warner Bros. Television, a division of WB Studio Enterprises Inc., Bad Robot Productions and each of their respective parent, subsidiaries and affiliated companies, distributors, web design, advertising, fulfillment, judging and Contest agencies involved in the administration, development, fulfillment and execution of this Contest (collectively, "Contest Parties"), and the immediate family members (spouse, parent, child, sibling and spouse or "step" of each) and those living in the same households (those persons whether related or not who live in the same residence for at least three months during the twelve-month period preceding the start date of the Contest) of each such employee, contractor, director or officer.
Contest Duration
The contest will commence at 6am Eastern Daylight Time on Thursday, August 4, 2010 and all submissions must be received no later than 11:59pm Eastern Daylight Time, Friday, September 3, 2010 (The "Closing Date"). You may register for and enter the contest at anytime during this period.
HOW TO ENTER
Registration and Submissions Process:
One entry per participant. All registrations and final submissions must be filled out and submitted via the official online registration and submission forms and file upload prompts at www.appnationconference.com.
TERMS OF SUBMISSION
As conditions of entry into this Contest, and by uploading a Submission, each Entrant:
- WARRANTS AND REPRESENTS THAT THE ENTRANT OWNS ALL RIGHTS OR IS AUTHORIZED TO SUBMIT, TO THE SUBMISSION HE/SHE IS ENTERING IN THIS CONTEST;
- WARRANTS AND REPRESENTS THAT THE ENTRANT HAS THE AUTHORITY TO GRANT THE RIGHTS TO THE CONTEST PARTIES DESCRIBED IN THESE RULES;

- agrees to indemnify and hold the Contest Parties, harmless from any and all claims, damages, expenses, costs (including reasonable attorneys' fees) and liabilities (including settlements), brought or asserted by any third party against any of the Promotion Indemnitees due to or arising out of the Entrant's Submission, or the Entrant's conduct during and in connection with this Contest, including but not limited to trademark, copyright, or other intellectual property rights, right of publicity, right of privacy or defamation; and
- agrees to release and indemnify and hold harmless the Contest Parties from any and all claims that any commercial, advertising, presentation, web content or any other material subsequently produced, presented, and/or prepared by or on behalf of Sponsor or the Contest Parties infringes on the rights of Entrant's work as contained in any Submission.
Prizes
First Place:
- One (1) Grand Prize Winner will receive a single, lump-sum payment of $10,000 and the opportunity to have his/her winning Submission developed into a FOX App, subject to and in the sole and absolute discretion of FOX.
- The Grand Prize Winner will be announced and will receive official recognition as the Winner and receive a check on the APPNATION Keynote Stage.
Second Place:
- One (1) Second Place Winner will be publicly acknowledged as the runner-up on the Keynote Stage and receive US$1,000 in the form of a check.
Judging Criteria
All submissions will be judged, and all winners chosen, by a FOX panel consisting of FOX, Fringe production and/or Appnation personnel, with the final decision to be made by FOX, which will be final in all respects. The Judging Criteria are:
- Ease of use;
- General look and feel;
- Innovation features; and
- Best use of the application technology to deepen consumer engagement with the Fringe brand.
Eligible Entries
No entries may be submitted, and no winners selected, from those who have not officially registered for the Contest.
NATURE OF RELATIONSHIP/WAIVER OF EQUITABLE RELIEF: Each Entrant understands and acknowledges that the Contest Entities have wide access to ideas, stories, designs, and other literary materials, and that new ideas are constantly being submitted to it or being developed by their own employees. Each Entrant also acknowledges that many ideas or stories may be competitive with, similar or identical to the Submission and/or each other in theme, idea, plot, format or other respects. The Contest Parties make no warranties, express or implied, as to the content or the accuracy or reliability of any information or statements contained in the Submissions. All statements and opinions made by Entrants are those of such Entrants only, and the Contest Parties neither endorse nor shall be held responsible for the reliability or accuracy of same. Sponsor is not responsible for the content or practices of third party Web sites that may be linked to the Contest website. This site may also be linked to Web sites operated by companies affiliated with Sponsor. Visitors to those sites should refer to each site's separate privacy policies and practices.
GENERAL TERMS AND CONDITIONS: By participating, each Entrant agrees that the Contest Parties and each of their respective agents, representatives, parent companies, affiliates, subsidiaries and legal advisors, and each of their respective employees, shareholders, officers, and directors are not responsible or liable for, and shall be released and held harmless from: (i) late, lost, delayed, damaged, incomplete, illegible, unintelligible, misdirected or otherwise undeliverable mail, postage-due notices, release forms, affidavits or other correspondence; (ii) telephone, electronic, hardware or software program, network, Internet or computer malfunctions, failures, or difficulties of any kind; (iii) any condition caused by events beyond the control of the Contest Parties that may cause the Contest to be disrupted or corrupted; (iv) any printing, human, typographical or other errors or ambiguities in (or involving) any materials associated with the Contest; (v) any and all losses, damages, rights, claims and action of any kind in connection with or resulting from participation in the Contest; (vi) acceptance, possession, or use of any grant, including without limitation, personal injury, death and property damage arising there from; and (vii) claims based on publicity rights, defamation or invasion of privacy.
The Contest may also be promoted by a third party or parties (each a "Promotional Partner," collectively "Promotional Partners"). Entrants shall indemnify and hold harmless the Contest Partiers, any Promotional Partners, and each of their respective parents, affiliates, successors, assigns and licensees, and each of their respective employees, shareholders, officers, directors, agents and representatives from and against any and all liability, claims, loss, damage, injury or expense, including reasonable attorneys' fees, arising in connection with any third party action arising out of a breach or allegation which if true would constitute a breach, of any of Entrant's representations, warranties or obligations herein.
All issues and questions concerning the construction, validity, interpretation and enforceability of the Contest, or the rights and obligations of Entrants and the Contest Parties in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions. In the event of a claim or dispute, Entrants' sole remedy shall be limited to their remedy at law for damages, if any, and Entrants shall not have the right to in any way enjoin or restrain the distribution, advertising, publicizing or other exploitation (in any form of media) of the Website, the Contest, and/or any intellectual property owned or licensed by the Contest Entities or their respective parent companies and affiliated entities.
Sponsor reserves the right, in its sole discretion, to suspend or cancel the Contest at any time for any reason, including, without limitation, if a computer virus, bug or other technical problem corrupts the administration, security, or proper conduct of the Contest, strikes, lock-outs, acts of God, technical difficulties, and other events not within the reasonable control of Sponsor.
Sponsor reserves the right, at its sole discretion, to prohibit any Entrant from participating in the Contest or to disqualify any individual it finds, in its sole determination, to be tampering with the entry process or the operation of the Contest; to be attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or any other unfair playing practices; to be acting in violation of the Official Rules; or to be acting in a disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Sponsor may suspend or discontinue the Contest if, in its sole opinion, there is any actual or suspected tampering of the Contest, or any other malfunction, event or activity that may affect the integrity of the Contest. SPONSOR SHALL NOT BE OBLIGATED TO AWARD ANY PRIZE THAT RELATES TO OR ARISES OUT OF IMPROPER OR MISTAKEN PRIZE NOTIFICATION, OPERATION OR FUNCTION OF THIS CONTEST.
